The Evolution of Regulation E Opt-In Requirements
Regulation E was created under the Electronic Fund Transfer Act (EFTA) of 1978 to protect consumers in electronic financial transactions. However, its signature overdraft opt-in rule emerged following the 2008 financial crisis:
- 2009 Federal Reserve Rule: In November 2009, the Federal Reserve Board amended Regulation E to address automatic overdraft enrollments, creating an “opt-in” regime instead of an “opt-out” default.
- 2010 Implementation: Effective July 1, 2010, financial institutions were legally prohibited from charging overdraft fees on ATM and one-time debit card transactions unless the consumer explicitly provided affirmative consent.
- Consumer Impact: The mandate ensured consumers were not surprised by unexpected fees for small-dollar point-of-sale or cash withdrawal overdrafts, requiring institutions to clearly outline coverage policies before collecting consent.
Streamlining Modern Reg E Opt-In Channels
Consumers must explicitly opt in to include ATM and everyday debit card transactions in their Overdraft Privilege (ODP) coverage. While financial institutions should provide the ODP Policy and A-9 Consent Form during account opening, customers can also opt in at a later date.
Consumers can submit their Reg E election through four channels:
- In Person: At any branch location.
- By Phone: Direct telephone requests.
- By Mail: Physical submission of the A-9 form.
- Electronically: Via online forms.
Note: Business accounts are exempt from Reg E opt-in requirements for ATM and everyday debit card coverage.
